Hi Guys,
I was just interested if any of you have taken part in a class action for IBD related to accutane use? I've been contacted by a lawyer and am somewhat reticient aobut joining. Any one go through with it? How did it work?

You might also consider a small claims court. Your reward will be capped (about $10,000) but that may be a lot more than you'd get in a class action lawsuit.


First UC flare: 11/4/08
Admitted to hospital: 11/10/08
Total colectomy: 12/10/08
J-pouch construction: 3/10/09
Takedown: 8/19/09

Yeah, generally, the only ones who make out on class actions are the attorneys. And, once you join the class, you forfeit any individual action you may have considered. But, if you weren't going to file anyway, the class action might be OK. I've been in on non-medical class actions and I think the most I ever got was $50. The worst was a coupon. At least with the class action, there is no hassle on your part. But you probably would have to sign a medical information release.

I spoke to the lawyer who contacted me and they sent out a contract to sign & a medical release...my only 'worry' was that there is a tiny little clause that says that if for any reason they cannot recoup their legal fees than I am to pay them out of pocket...sounds like a nasty loophole where if I win, I win almost nothing but it I loose, I loose everything...being that I am generally not lucky at this sort of thing, I think that I will beg off.

Hi skn69,

I would make a deal with the "lawyer" that if he isn't able to win a settlement in your favor, you get his colon, and of course, you would gladly pay his "legal" fees.

I would use his "contract" for one of my 15+ BMs a day.

Nah, I would deinitely skip any class action that requires you to pay any legal fees if you lose. It is an uphill battle anyway. Who needs it?
